These Terms of Service ("Terms") govern your use of the Eye Vision Training App Android application ("App") and the website EyeVisionApp.com ("Website"). By downloading the App, visiting the Website, or subscribing to our service, you agree to these Terms.
1. Description of the service
EyeVisionApp.com provides vision training games designed to support dichoptic therapy (e.g. for lazy eye / amblyopia and binocular fusion). The App is intended to be used under the guidance of an eye-care professional and does not replace a full eye examination or medical advice.
2. Eligibility and account
You must be at least 13 years old (or the age of consent in your country) to use the App and Website, or have parental or guardian consent. Subscription is tied to a Device ID. You are responsible for keeping your Device ID and any login or payment details secure. One subscription is intended for one device unless we state otherwise.
3. Subscription and payment
Subscriptions and one-time purchases are offered through the Website. Payment is processed by our designated payment provider. By subscribing, you agree to pay the stated fees and to any refund and cancellation rules we publish on the Website. We may change pricing or plans with notice; continued use after changes constitutes acceptance. Trial periods (e.g. 3-day trial) are subject to the terms shown at sign-up.
4. Acceptable use
You agree to use the App and Website only for lawful purposes. You must not:
- Reverse-engineer, copy, or redistribute the App or Website content beyond normal use.
- Use the service to harm others or to violate any law.
- Attempt to bypass subscription or access controls (e.g. sharing or faking Device IDs to avoid payment).
- Interfere with our servers, networks, or other users.
We may suspend or terminate access if we reasonably believe you have breached these Terms.
5. Medical disclaimer
The App is a tool to support vision training and is not a medical device. It does not diagnose, treat, or cure any eye condition. Results may vary. Always follow the advice of your eye-care professional. We are not liable for any health outcomes from using the App.
6. Intellectual property
The App, Website, and their content (including games, text, and design) are owned by us or our licensors. We grant you a limited, non-exclusive licence to use the App and Website for personal, non-commercial use in accordance with these Terms. You may not remove copyright or other notices.
7. Privacy
Your use of the App and Website is also governed by our Privacy Policy, which describes how we collect, use, and share your data. By using the service, you consent to that processing.
8. Limitation of liability
To the fullest extent permitted by law, we provide the App and Website "as is". We do not guarantee that the service will be error-free or uninterrupted. We are not liable for any indirect, incidental, or consequential damages (including loss of data or profit) arising from your use of the service. Our total liability shall not exceed the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain exclusions; in those cases, our liability is limited to the maximum permitted by law.
9. Changes to the Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. We will notify you of material changes via the App or the Website (or by email if we have it). Continued use after the change means you accept the updated Terms.
10. Governing law and disputes
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of India, unless we agree otherwise or your local law requires a different jurisdiction.
